TRUTANICH - MICHEL, LLP February 22, 2000 To all Roberti-Roos "Assault Weapon" owners effected by the recent DOJ policy change invalidating post 3/31/92 registrations: We intend to file Administrative Claims for compensation under the California Government Tort Claims Act to recover the cost of your firearm(s) from the State of California. We are filing these on behalf of approximately 100 clients presently. If you wish, we can file one on your behalf as well. If you were forced to dispose of your Roberti-Roos "Assault Weapon" due to the recent change of DOJ policy which invalidated registrations issued after March 30, 1992; or if you disposed of your Roberti-Roos "Assault Weapon" because the DOJ's policy change makes it impossible for you register your weapon in the future, please provide the following information to this office: 1) Your name, address, and telephone number; 2) The make and model of the firearm you disposed of; 3) The date you first acquired the firearm; 4) Copies of any and all documentation you have regarding the firearm including all DOJ correspondence and: A) If you relinquished or destroyed the firearm; 1) The value of the firearm and all documentation supporting the value and evidencing the relinquishment or destruction; B) If you sold the firearm at below market value; 1) The amount you sold the gun for and all documents evidencing the sale; 2) The market value of the firearm and all documents evidencing the market value; This office will take the information, insert it into a proper claim form, and submit the claims to the State of California. It is anticipated that these claims will be denied, at which time a lawsuit will be initiated and consolidated with the existing legal action challenging the DOJ's policy change. If you have previously submitted information to this office, please supply the additional information regarding the value of your firearm and the manner of disposal. We will not charge fees to individual claimants for this service up front, but will seek attorney's fees from the State through subsequent litigation. Nonetheless, voluntary donations made out to the "NRA Firearms Civil Rights Legal Defense Fund - California Litigation" or the "NRA - Institute for Legislative Action - California Litigation" are appreciated.
