signed by Governor Gray Davis of California Governor Davis had earlier announced his support for SB255 when he hailed the legislation as a "First in the Nation" law. On Friday September 5, 2003, it was announced that Governor Davis signed SB255 by Senator Ducheny, which was sponsored by the California Attorney General and the National Rifle Association. Under current California law, a person must attempt to purchase a firearm before they can undergo a State and Federal background check to verify their legal status for the possession of a firearm. This simple act of attempting to purchase a firearm is a crime if you are prohibited from possessing a firearm even if you did not realize that you were prohibited. In the past, Californians have inadvertently violated State and Federal law when attempting to purchase firearms because they were unaware that minor misdemeanors committed in other states where they may have lived in the past, protective orders, or inaccurate court or law enforcement records, make them prohibited. The new procedures created by SB255 will allow persons to confirm their status and seek legal help to correct and seek remedies to clear problematic criminal justice records without placing themselves in further legal jeopardy. The provisions of SB255 will allow persons to pay $20.00 and undergo a State and Federal background check to determine their legal status for purchasing firearms without risking violating State and Federal law in the process. It should be noted that SB255 is a fine example of what a “common sense gun law” should be all about. This bill received true bi-partisan support and went through the entire legislative process, in both houses, without a single “NO” vote. Senate Bill 255 is long overdue and allows a person to comply with State and Federal laws without becoming a victim of government bureaucracy.
